Deen was called a hypocrite for continuing to promoting her high-fat and sugar diet while revealing her medical condition only when it benefited her in representing the drug company to market their diabetes management program. A former employee of Deen’s restaurant and her brother Earl “Bubba” Hiers, a white female American, Lisa Jackson, filed a lawsuit of allege racial and sexual discrimination, claimed that Deen made derogatory and offensive  remarks regarding African Americans because her nieces are bi-racial with an African-American father. However, a federal judge dismissed the claims of racial discrimination that were brought by Lisa Jackson, on August 12, 2013, and the judge ruled that Jackson cannot claim to be a victim of racial discrimination which targets the African American employees, because she is white and that she is just “an accidental victim” of the alleged racial discrimination case. Both parties decided and agreed to drop the lawsuit without any award of costs of damages or fees to any party.
